تفعيل اختصاص المحكمة الجنائية الدولية لإنصاف ضحايا جريمة الترحيل القسري

Abstract

تباشر العديد من الحكومات والجماعات في إطار النزاعات المسلحة عمليات ترحيل قسري ضد المدنيين والسكان، وذلك إما بطريقة مباشرة عبر نقلهم داخل حدود البلد الواحد والتهجير إلى دول أخرى، أو بطريقة غير مباشرة عبر استخدام أساليب التخويف والاضطهاد، وذلك لدفعهم للفرار وإخلاء المناطق التي يقطنون فيها بصفة مشروعة. حيث تهدف هذه الدراسة لتكييف جريمة الترحيل القسري، وتحديد اختصاص المحكمة الجنائية الدولية في متابعة المسؤولين عنها، ودورها في تكريس حقوق الضحايا مثل الحق في التعويضMany governments and groups during armed conflicts carry out forcible transfers against civilians and populations, directly by either transferring them within the borders of one country or displacing them to other countries, or indirectly with intimidation and persecution in order to force them to flee the areas where they live in it legally. This study aims to adapt the crime of forced deportation, and to determine the competence of the International Criminal Court to pursue those responsible, and its role in enshrining victims' rights such as the right to compensation
