ضوابط اعتبار عموم البلوى في فقه الأقليات المسلمة -باب المعاملات أنموذجا-

Abstract

الملخص: تسعى هذه الدراسة الى بيان ضوابط اعتبار عموم البلوى في فقه الأقليات المسلمة، وذلك من خلال تحديد أثر عموم البلوى في إباحة بعض نوازل الأقليات التّي عمّت بها البلوى و التّي لم يفترض إباحتها، ولكن الفقهاء أجازوها بالنظر إلى مصالح هذه الأقليات واحتياجاتهم تحقيقا لمبدأ التيسير ورفع الحرج في الشريعة الإسلاميّة، مع التركيز على تحديد المراد بعموم البلوى، وأدلة اعتباره سببا للتيسير ورفع الحرج، وبيان معنى فقه الأقليات المسلمة وتأصيله، ومن ثمّ توضيح الضوابط من خلال تطبيق عموم البلوى على نماذج من نوازل الأقليات المسلمة في باب المعاملات، مع بيان وجه إعمالها في هذه النّماذج المختّارة. Abstract: This study seeks to clarify the controls of the consideration of the Ummom el balwa in the jurisprudence of Muslim minorities, by determining the effect of the Ummom el balwa in the legalization of some minority tendencies that have been generalized by the blues and which were not supposed to be opened, but the jurists authorized them in view of the interests of these minorities and their needs in order to achieve the principle of facilitation. And raise the embarrassment in Islamic law, focusing on determining what is Ummom el balwa, and the evidence of considering it as a reason for facilitation and lifting of embarrassment, and to clarify the meaning of the jurisprudence of Muslim minorities and its rooting, and then clarifying the controls by applying all the Ummom el balwa to models of the muslim minorities in the section of transactions, with a statement of the face of realized in these synoun approaches.
