ثبوت الشخصية الحكمية والذمة المالية للشركة في ضوء أحكام الفقه الإسلامي

Abstract

الملخص: تعتبر الشخصية الحكمية من العناصر الأساسية التي أضيفت للشركات حديثا، وتميزت بها عن الشركات في الفقه الإسلامي، وينظر إليها على أنها اجتماع مجموعة من الأموال أو الأفراد لتحقيق غرض عام أو مشترك، وأنه اقتضتها ضرورات الحياة العملية، ومنها ترتيب الحقوق والالتزامات. وقد انتهى البحث من خلال التحليل إلى لزوم القول بالشخصية الحكمية، وأنها من مستلزمات مصلحة الاشتراك ذاته، فضلا عن مصالح الغير، وأن هذه الشخصية تستتبع أن يكون لها ذمة مالية خاصة بها، حيث أنها أساس الفكرة أصلا، كما انتهى البحث إلى أن وقت ثبوت الشخصية للشركة يتحدد بعملية خلط الأموال، وأن الاعتراف القانوني بها إنما هو لتقرير حقيقة قائمة، وأنه بثبوت الشخصية الحكمية للشركة تكون لها أهلية وجوب كاملة، وأن أهلية الأداء تتحدد بالغرض المحدد لها. ABSTRACT: The moral personality is one of the basic elements that have been added to companies recently. They have been distinguished from companies in Islamic jurisprudence.
