مفهوم حقوق الإنسان وموقعه في الفكر الإسلامي المعاصر

Abstract

ملخص: في تحديد مفهوم الحق عند فقهاء الشريعة، هناك ثلاثة اتجاهات رئيسة: الأول: أنه مصلحة ثابتة لصاحبه. الثاني: ما هو شرعه الله تعالى وأقره لعباده. الثالث: علاقة اختصاص بين صاحب الحق ومحله. وقد قسموه إلى قسمين رئيسين هما: حق الله، وحق العباد... أما حقوق الإنسان في الاصطلاح المعاصر فتعني: مجموعة الحقوق والمطالب التي يجب الوفاء بها لكل البشر على قدم المساواة، دونما تمييز فيما بينهم. أما موقع حقوق الإنسان في الفقه الإسلامي؛ فلا نجد بابا خاصا في كتب الفقه الإسلامي مختصا بحقوق الإنسان، ذلك أن الشريعة قد اهتمت بمعالجة كل حق في موضعه من الباب الفقهي الذي يتعلق به، وهناك من المعاصرين من دعا الى تخصيص باب مستقل لحقوق الإنسان. أما موقف المفكرين المسلمين تجاه الميثاق العالمي لحقوق الإنسان فيتلخص في التذكير بأسبقية الدين الإسلامي في تقرير حقوق الإنسان، مع التأكيد على الخصوصية الثقافية للعالم الإسلامي، ونقد ازدواجية المعايير في التنفيذ. Summary The notion of ‘Right’ in the Islamic jurisprudence can be concluded on three concepts: 1- The Right is a permanent benefit to its owner. 2- The Right is legislated by God. 3- The specific relation between the owner of the Right and its subject. The Right is divided into two main parts: God’s Right and Human Right. The Human Rights in the modern concept means: the total rights and needs which must be -equally- offered to every person, without any separation. We didn’t find a special chapter to Human Rights in jurisprudence books, because they used to detail each Right in its subject. Thus, the modern scholars claimed to specialize a new chapter to human Rights. The Islamic point of view about the world charter for human rights focussed on reminding the precedence of Islamic religion in deciding the Rights, confirming the specify of Islamic culture, and criticizing the duality of the practical standards.
