Abstract

ملخص: عرف العالم مع بداية القرن الواحد والعشرين تطورا تكنولوجيا هاما مس جميع ميادين الحياة لاسيما المجال المتعلق بوسائل الاتصال، أين تم اختراع العديد من التقنيات التي تساهم في الكشف عن الجريمة أهمها "جهاز الهاتف النقال"، إذ لم يعد استخدامه قاصرا على تسهيل التواصل بين الأفراد بل أصبح أداة مهمة لمواجهة الجريمة المنظمة وضبط مرتكبيها، وذلك بالتنصت على محادثاتهم وتسجيلها من أجل الحصول على الدليل الجنائي الالكتروني، إلا أن التنصت على المحادثات التليفونية قد عرض في العديد من الأحيان حق الإنسان في المحافظة على حياته الشخصية للخطر، وذلك باقتحام خلوته وتجريده من كل أسراره دون أن يشعر بشيء مما يجري حوله ويقع عليه ويمس أخص خصوصياته، فأدى هذا الأمر إلى البحث في مدى مشروعية هذه التسجيلات في الإثبات الجنائي. من هذا المنطلق تهدف هذه الدراسة إلى الوقوف على المقصود بالتسجيل الصوتي بالهاتف النقال وتحديد مشروعية الدليل الالكتروني المتحصل عليه من هذا التسجيل في الإثبات الجنائي. From this point, This study aims to stand on purpose voice recording on a mobile phone to determine the legality of electronic guide obtained from this recording in criminal evidence.
