تزوير التوقيع الالكتروني في بطاقات الائتمان- دراسة على ضوء القانون 15-04 المتعلق بالتوقيع والتصديق الالكترونيين

Abstract

نهدف من خلال هده الدراسة إلى تسليط الضوء على جريمة تزوير التوقيع الالكتروني لبطاقات الائتمان التي ظهرت نتيجة التطور التكنولوجي في المجال المصرفي، إذ أصبح الأفراد والمؤسسات بواسطة البطاقة القيام بعمليات الدفع والوفاء الكترونيا لمختلف السلع والخدمات والتي لا يمكن أن تتم إلا بواسطة تقنية حديثة ألا وهي التوقيع الالكتروني السري لحامل البطاقة، على عكس التوقيع التقليدي الذي يكون في المحررات الكتابية، وبصدور قانون 15 / 04 المنظم للتوقيع الالكتروني يمكن اعتبار بطاقات الائتمان من المحررات الالكترونية التي قد تقع عليها جريمة التزوير، وهي من الجرائم المستحدثة والخطيرة التي تمس الأمن المعلوماتي للأفراد وتضر بالاقتصاد الوطني وتضعف الثقة بين صاحب البطاقة والبنك. Through this study, we aim to highlight the crime of falsification of electronic signature, which has emerged as a result of the technological development in the banking field, as individuals and institutions have become by card to make payments and meet electronically for various goods and services, which is done only by modern technology.
