مشروعية الوسائط الرقمية في الإثبات الجنائي

Abstract

لقد عرف التعامل بالوسائط الرقمية انتشارا واسعا فظهر ما يعرف بالدليل الرقمي، الذي أصبح لزاما على أجهزة العدالة أن تتعامل معه كدليل مستحدث في مجال الإثبات الجنائي شأنه شأن الدليل التقليدي وهنا تكمن أهمية هذا الموضوع الذي يطرح إشكالا حول مشروعية الاعتماد على الدليل الرقمي لإظهار الحقيقة في إطار الشرعية القانونية، ومن ذلك فإن هذه الدراسة تهدف إلى تسليط الضوء على الدليل الرقمي من خلال مناقشة إطاره المفاهيمي من حيث البحث في مفهومه وخصائصه إضافة إلى إجراءات استخلاصه مونها تختلف في كل ذلك عن الأدلة التقليدية وكذا مشروعيته في الإثبات الجنائي بإثارة سلطة القاضي الجزائي في قبول هذا الدليل والأخذ به وكذا ضوابط اقتناعه به. Electronic usage has spread widely in such a way it has paved the way to what it called the electronic evidence, which is required by the justice system to treat it as a new proof in the criminal evidence like the traditional proof, therein lies the importance of this subject witch poses problematic about the legality of the digital evidence. This study aims to highlight on this new evidence by discussing it’s conceptual framework in terms of researching it’s concept and characteristics, as well as the procedures of its extraction, along with its legitimacy in the criminal evidence by raising the power of criminal judge to accept and adopt this proof, as well as the rules of his conviction.
