الحمایة القانونیة لحقوق الملكیة الصناعیة ودورها في جذب الإستثمارات الأجنبیة المباشرة في الجزائر

Abstract

This study aims to determine the resulting relationship between the legal protection of industrial property rights and the attraction of foreign direct investments to Algeria. This study was carried out by addressing the concept of legal protection of industrial property rights as well as its types, and its role in attracting foreign direct investments. We also outlined the most important reforms undertaken by Algeria, in order to create an appropriate and supportive environment for the promotion of businesses and investments, especially those that are based on knowledge. To conclude, in the end, that the legislative side has a pivotal role in protecting industrial property rights, and despite the improvement in the environment for defining industrial property rights and working to protect them and enacting laws related to punishing their violation, the current reality of effective and proper application of laws does not keep pace with the progress made globally, and there is an urgent need To update them in line with the size of the violations that have occurred, some of them are weak and contain loopholes and others do not keep pace with development and suffer from deficiencies or defects in implementation, which casts a shadow on economic growth and the movement of investments.. تهدف هذه الدراسة إلى تحدید العلاقة الناجمة بین الحمایة القانونیة لحقوق الملكیة الصناعیة و جذبا لاستثمارات الأجنبیة المباشرة إلى الجزائر، و لقد تمت هذه الدراسة من خلال التطرق لمفهوم الحمایة القانونیة لحقوق الملكیة الصناعیة وكذا أنواعها، ودورها في استقطاب الاستثمارات الأجنبیة المباشر ة . كما بینّا أهم الاصلاحات التي قامت بها الجزائر، من أجل خلق مناخ ملائم ومساعد لترقیة الاعمال و الاستثمارات لاسیما التي ترتكز منها على المعرفة. لنخلص في الاخیر، أن للجانب التشریعي الدور المحوري في حمایة حقوق الملكیة الصناعیة، ورغم تحسن مناخ التعریف بحقوق الملكیة الصناعیة والعمل على حمایتها وسن القوانین المتعلقة بالمعاقبة على انتهاكها، إلا أن الواقع الحالي لتطبیق القوانین بشكل فعاّل وسلیم لا یواكب التقدم الحاصل عالمیا، وهناك حاجة ملحة إلى تحدیثها بما یتلاءم وحجم الانتهاكات الحاصلة، فبعضها ضعیف ویتضمن ثغرات والآخر لا یواكب التطور ویعاني من قصور أو من خلل في التطبیق، وهو ما یلقي بظلاله على النمو الاقتصادي وحركة الاستثمارات.
