Abstract

تتطلب هيكلة الدولة عقب مراحل الانتقال الديمقراطي تنظيم العلاقة بين مكوناتها واجهزتها ضمن مقاربة مؤسساتية تفترض اعادة الاعتبار لمفاهيم الحوكمة عبر عدد من الاجراءات والتشريعات، التي تضمن تكريس أبعاد الحكامة الرشيدة على الاستراتيجيات والسياسات التي تستوجب الحفاظ على النظام العام وحماية الديمقراطية وحقوق الانسان كمطلب اساسي، وتتناول هذه الدراسة التكريس القانوني والدسترة التشريعية لمقتضيات الحوكمة ضن برامج الاصلاح السياسي وتسلط الضوء على التجربة التونسية في هذا المجال وكل ما اعقب الفترة الانتقالية من تضمين لأسس الحوكمة. This study deals with the legal and legislative entrenchment of governance requirements in the political reform programs and highlights the Tunisian experience in this area and all that followed the transitional period of including the foundations of governance.
