جهود منظمة الأمم المتحدة لمكافحة الفساد

Abstract

This thesis addresses the United Nations' efforts to combat corruption through more than three decades. It discusses the ability of the international community to deal with all those efforts and implementing their outputs to restrain the phenomenon which is daily creating new challenges. The study shows the multi - dimensional levels of challenges that have emerged mainly through the acceleration of the globalization process in economic and political manifestations. It also shows the growing of the corruption and generates its effects on both national and international level. The study has addressed by the analysis the most important UN’s efforts to combat corruption through its institutions, the relevant conventions and legal documents, and its conference to Prevent Crime and the Treatment of Offenders. In the latter, all those efforts have culminated in the United Nations Convention against Corruption, so-called “Merida” which formed a qualitative evolution in combating against the phenomenon, especially through the international cooperation mechanisms laid down; be it traditional or developed. Standing on the most important institutions, legal documents and conferences that framed the UN efforts to combat corruption for three decades, the study stumbled on the fact that, in spite of the richness, diversity and multiplicity of legal outcomes and its long relatively trajectory, the level reached by the UN efforts in this area is not able to reach the required level to deal positively with combating corruption. تناولت هذه الأطروحة، جهود منظمة الأمم المتحدة لمكافحة الفساد خلال ما يزيد عن ثلاث عقود، ومدى قدرة المجتمع الدولي على التعاطي الإيجابي مع تلك الجهود، وقدرة توظيف مخرجاتها من أجل تطويق الظاهرة، التي تخلق تحديات جديدة يوما بعد يوم. تحديات متعددة الأبعاد والمستويات، برزت أساسا من خلال تسارع مسار العولمة بتجلياتها الاقتصادية والسياسية، وتنامي ظاهرة الفساد وما تولد عنها من أثار على المستويين الوطني و الدولي. وقد عملت الدراسة على رصد وتحليل أهم مساعي الأمم المتحدة في سبيل مكافحة الفساد من خلال أجهزتها وأهم الاتفاقيات والوثائق ذات الصلة التي أعدت تحت مظلتها. وكذلك من خلال أهم مؤتمراتها لمنع الجريمة ومعاملة المجرمين. وهي الجهود التي توجت باتفاقية الأمم المتحدة لمكافحة الفساد الموسومة ب "ميريدا"، هذه الأخيرة التي شكلت تحولا نوعيا في مسار مكافحة الظاهرة، لاسيما من خلال آليات التعاون الدولي التي نصت عليها؛ بتفعيل التقليدية منها واستحداث أخرى. فمن خلال الوقوف على أهم المؤسسات والوثائق القانونية والمؤتمرات التي أطرت مسار الجهود الأممية لمكافحة الفساد، على مسار ثلاث عقود، وقفت الدراسة على حقيقة المستوى الذي وصلت إليه الجهود الأممية في هذا المجال، حيث أنه وبالرغم من ثرائها وتنوعها وتعدد مخرجاتها القانونية ومسارها الطويل نسبيا، فإنها لم تتمكن من الوصول إلى المستوى المطلوب للتعاطي الإيجابي مع مكافحة الفساد.
