الحماية الدولية لحق الإنسان في بيئة نظيفة

Abstract

تهدف هذه الدراسة إلى وضع إطار قانوني للحماية الدولية للبيئة، لتوفير حماية فعالة سارعت الدول إلى البحث عن أساليب و آليات قانونية و ذلك لتعويض الأضرار البيئية، و كذا إعادة الحال إلى ما كان عليه قبل التلوث البيئي، و تحقيق لهذا الغرض أبرمت العديد من الاتفاقيات و المعاهدات الدولية و الاقليمية لوضع الأسس و الاجراءات اللازمة لحماية البيئة. إن دراسة هذا الموضوع بصفة كاملة و شاملة يستدعي اتباع تطورات حقوق الانسان و خاصة الجيل الثالث، على اعتبار أن حق الانسان في بيئة نظيفة يشكل أحد مكونات هذا الجيل. و أنتهينا إلى أن حق الانسان في بيئة نظيفة هي مسألة داخلية، لذا فإن الحماية الدولية لحق الانسان في بيئة نظيفة لا تقي بحال من الأحوال عن الحماية الداخلية له. This study focuses on the legal protection of the environment and international development of legal instruments and mechanisms to repair damage to the environment. Illustrating the global nature of the phenomenon and its place in political and geopolitical world, international actions related to the environment are multiple; conventions, agreements and protocols, international summits, international days...The study of this project in its entirety requires a global view of the evolution of human rights especially the right to a healthy environment that belongs to the third generation. Finally, if the healthy environment acquired the status of a fundamental right is that it has become an expression of public policy of collective interests expressing solidarity not only within states but the internationally. Cette étude porte sur les mesures juridiques de protection internationales de l'environnement et l'élaboration d'instruments et de mécanismes juridiques de réparation des atteintes à l'environnement. Illustrant la globalité du phénomène et sa place dans le monde politique et géopolitique, les actions internationales en lien avec l'environnement se sont multiples; conventions,accords et protocoles, sommets internationaux, journées mondiales et ...Létude de ce projet dans son intégralité requiert une vue globale de l'évolution des droits de l'home surtout le droit à un environnement sain qui appartient à la troisième génération. Enfin si l'environnement sain acquis le statut d'un droit fondamental, c'est qu'il est devenu l'expression d'une politique publique d'intérêts collectifs exprimant des solidarités non seulement à l'intérieur des états mais à l'échelle internationale. Diese Studie konzentriert sich auf den rechtlichen Schutz von Umwelt und internationale Entwicklung der rechtlichen Instrumente und Mechanismen zur Reparatur von Schäden an der Umwelt. Zur Veranschaulichung der globalen Natur des Phänomens und seine Position in politischen und geopolitischen Welt, sind internationale Aktionen in Bezug auf die Umwelt mehrere; Konventionen, Abkommen und Protokolle, internationale Gipfeltreffen, internationale Tage...Das Studium der dieses Projekt in seiner Gesamtheit erfordert, dass eine globale Sicht auf die Evolution der menschlichen Rechte insbesondere das Recht auf eine gesunde Umwelt,die der dritten Generation gehört. SchlieBlich, wenn die gesunde Umwelt den Status eines Grundrechts erworben ist, dass es ein Ausdruck der Politik der Kollektiven Interessen, die Solidarität nicht nur innerhalb der Staaten geworden ist aber die International.
