العلاقة بين رئيس الجمهورية والوزير الأول في النظام الجزائري

Abstract

La réorganisation de l’Autorité Exécutive et l’illustration de la relation entre le Président de la République et le Président du Gouvernement, qui n’est plus le Président du Gouvernement mais le premier ministre. Le Président de la Gouvernement constitutionnellement dans l’amendement 2008 c’est le Président de la République, mais le Premier Ministre dans le gouvernement du Président de la République sa mission est de coordonné et viellé sur l’ajustement du travail du gouvernement et maitre les plans et les moyens avec le but est d’appliqués les politiques et les programmes que the Président de la République approuve. Le renforcement de l’Autorité Exécutive est en augmentation continu à l’intérêt de priorité pour les termes de référence du Président de la République qui ont excédés toutes les expectations, ce qui ne donne pas une correcte adaptation au gendre du system existant en Algérie. Ce la ne permit pas déterminé le type de relation existante entre les deux têtes de l’Autorité Exécutive, est ce qu’elle est une relation de dépendance ou une relation complémentaire? une relation de violation des termes de référence de un des deux parties? ou une relation d’indépendance dans le cadre des régulations et les textes de la constitution et les lois? Cette étude à divulgué que le Président du Gouvernement joue un rôle relativement fiable, car par le fait il na pas de sortie tant que le Président de la République intervient d’une façon effective pour prendre une décision ou faire mobiliser l’activité gouvernementale. L’aménagement interne de l’Autorité Exécutive abouti sur le principe bilatéral, si il s’inspire son duplication basé sur le Système Parlementaire, mais cela est apparemment seulement; parce que le terme de référence exécutif ne se repose pas entre les mains du Président du Gouvernement et n’existe pas sous le Premier Ministre, qui alimente le chef de l’état-major de l’équipage ministérielle et il n’est que juste le coordinateur de l’activité exécutive, alors la dépendance existante et proéminente et l’indépendance est inexistante. The reorganization of the Executive Authority and the illustration of the relation between the President of the Republic and the Head of the Government, who do not remain the government’s head but he is the Prime Minister. And the Government’s Head constitutionally in the amendment of year 2008 is the President of the Republic; while the Prime Minister has a recipe of the First Minister in the President of the Republic Government, his task is to coordinate and to ensure the adjustment of the government work, and the put of plans and the means efforts for executing the policies and the programs that the President of the Republic approves. The enhancement of the Executive Authority is in increase for the interest of giving priority to the President of the Republic for reference terms that exceeded all expectations, which don’t give a correct adaptation to the type of the existing-system in Algeria; this doesn’t allow determining the kind of the existing relation between both heads of the Executive Authority; whether an independent relation or a complementary relation, whether an infringement relation over the specialties of one part of both or an independency relation in the frame of regulations and Constitutional Texts and Laws. This study has enclosed that the President of the Government plays a slight and a relative role; because in fact he has no issue from that, when the President of the Republic intervenes with an effective way to take decision and to move the Governmental Activity. The internal configuration of the Executive Authority standing on the bilateral principle is inspires its duplication from that of the Parliamentary System; yet this only appeared ostensibly, for the excusive specialty doesn’t focus on the hand of the government’s president, and is non-existent under the Prime Minister, who feeds the President Staff and the Ministerial Crew and as a coordinator of the Executive Activity; then the dependency is obvious and the independence is lacked. إن إعادة تنظيم السلطة التنفيذية وتوضيح العلاقة بين رئيس الجمهورية ورئيس الحكومة الذي لم يعد رئيسا للحكومة، وإنما وزيرا أولا، وأن رئيس الحكومة من الناحية الدستورية في تعديل 2008 هو رئيس الجمهورية، أما الوزير الأول فله صفة أول وزير في حكومة رئيس الجمهورية، مهمته التنسيق والسهر على ضبط عمل الحكومة، ووضع المخططات والوسائل الرامية إلى تنفيذ السياسات والبرامج التي يقررها رئيس الجمهورية. إن تقوية السلطة التنفيذية في تزايد مستمر لصالح تغليب اختصاصات رئيس الجمهورية التي تجاوزت كل التوقعات، بما لا يعطي تكييفا صحيحا لنوع النظام القائم في الجزائر، وبما لا يسمح من تحديد نوع العلاقة القائمة بين رأسي السلطة التنفيذية، هل هي علاقة تبعية أم علاقة تكامل علاقة تعدي على اختصاصات أحد الطرفين أم علاقة استقلالية في إطار أحكام ونصوص الدستور والقوانين. إن هذه الدراسة أفصحت أن رئيس الحكومة يلعب دورا ضئيلا نسبيا، لأنه بفعل الواقع لا مخرج له من ذلك مادام رئيس الجمهورية يتدخل بصورة فاعلة في اتخاذ القرار وتحريك النشاط الحكومي . إن التهيئة الداخلية للسلطة التنفيذية القائمة على مبدأ الثنائية إن كانت توحي بأنها كازدواجيتها القائم عليها النظام البرلماني، لكن هذا ظاهريا فقط، لأن الاختصاص التنفيذي لا يرتكز في يد رئيس الحكومة وينعدم في ظل الوزير الأول ،الذي غذى رئيس أركان الطاقم الوزاري ومجرد منسق للنشاط التنفيذي فالتبعية قائمة وبارزة والاستقلالية منعدمة.
