الإثراء المتبادل بين البيئة و حقوق الإنسان

Abstract

The human rights system can be used in the legal protection of the environment due to the close relationship between the two topics. This approach will not only contribute to the protection of the environment, but also enrich its field and give it an intrinsic value more than just considering it as an object of right. On the other hand, the legal protection of the environment indirectly contributed to the protection and promotion of human rights, not only that, but it provided a significant enrichment of the human rights system, and brought about important transformations, if adopted, that would transfer it to a new era in which it addresses the problem of effectiveness that human rights suffers from, and responds to the changes taking place at all levels. So this enrichment between human rights and the environment will achieve double protection for us, so that when we legally protect the environment we contribute to protecting and enriching human rights, and vice versa when we protect human rights we contribute to protecting and enriching the environment, as a result of the existence of a relationship between them embodied in three forms: *The environment is a prerequisite for the enjoyment of all human rights. * The human right as a substantive or procedural right that can be used to provide protection for the various elements of the environment. *Integrating human rights and the environment into the concept of sustainable development. يمكن استخدام منظومة حقوق الانسان في الحماية القانونية للبيئة نظرا للعلاقة الوطيدة بين الموضوعين. و هذا النهج سيساهم ليس فقط في حماية البيئة و انما يثري مجالها و يعطيها قيمة جوهرية اكثر من مجرد اعتبارها كموضوع للحق. في المقابل ساهمت حماية البيئة قانونيا بطريقة غير مباشرة في حماية حقوق الانسان و تعزيزها، ليس هذا فقط بل قدمت اثراء معتبر لمنظومة حقوق الانسان، و ادخلت عليها تحولات هامة لو يتم تبنيها ستنقلها الى عصر جديد تعالج فيها مشكلة الفعالية التي تعاني منها حقوق الانسان، و تستجيب للتغيرات الحاصلة على كافة المستويات. اذن فهذا الاثراء بين حقوق الانسان و البيئة سيحقق لنا حماية مضاعفة، بحيث عندما نحمي البيئة قانونيا نساهم في حماية و اثراء حقوق الانسان، و العكس عندما نحمي حقوق الانسان نساهم في حماية و اثراء البيئة، نتيجة لوجود علاقة بينهما جسدت في ثلاث اشكال هي: * البيئة شرط اساسي و مسبق للتمتع بجملة حقوق الانسان. * حق الانسان كحق موضوعي او اجرائي يمكن استخدامه في توفير الحماية لمختلف عناصر البيئة. * دمج حقوق الانسان و البيئة في مفهوم التنمية المستدامة.
