Résumé: In the beginning of the nineties , Morocco entered a new phase of its political history aimed at achieving the democratic transition as the best solution to Morocco to exit from the internal and external crisis it suffered from in the 70s and 80s mainly due to the worsening internal economic, social and political conditions , the repercussions of the success of Iranian revolution and the escalation of Islamic movements in many Arab and Islamic countries , as well as the affection of Morocco by the experiences of democratic transition in Tunisia , Algeria and Mauritania fulfilling the theory of infection and snow balls ,Also Morocco was affected by international pressure caused by the collapse of the soviet Union and the emergence of unipolar led by the United States of America , and the application by financial institutions of political conditinality policy in echange for the granting of loans to Morocco . The Morroccan political system was concerned with three indicators for achieving the democratic transition process, namely , the establishment of a political consensus between the Royal Institution an the opposition , wich was translated by a political rotation that led to the formation of the first consensual rotation government in 1996 ,as well as the gradual amendment of the constitutional framework by three times .the first and second were during the reign of King Hassan 2 in 1992 and 1996, and the third and final amendment was in 2011 under the reign of king Mohammed 6 in addition to interest in human rights portal though the establishment of a legal arsnal to preserve the rights and freedoms of citizens using a specific strategy to address the file of human rights violations . The application of democratic transition indicators in Morocco has taken positive steps in the course of democracy ,but it has not been sufficient to achieve an effective democratic transition Morocco is still living the stage of transition from tyranny to democracy .The reasons For this are the Royal institution’s control over the formulation of political and constitutional reform in a horizontal , which preserves its dominant position over the political process and constitutional institutions , and their broad constitutional powers derived from the written constitution relating to the field of the presidency or unconstitutional powers derived from the constitution concerning the field of the Emirate of believers and governance. This duplication in the institutions of the Moroccan political system ( traditionl institutions , modern institutions ) hampers the process of democratic trantion because traditionl institutions dominate modern institutions and empties them of content , while achieving democratic transition requires breking with the past and the collapese Of old institutions and replacing them with modern democratic institutions . In addition to the above , the democratic transition in Morrocco suffers from the weakness of the institution of civil society and their inability to play their roles because of a number of internal and external impediments that restrict their independence and make them state – owned .in addition , the Moroccan political system continues to violate human rights despite the constitution and legal arsenal stiputed to protect the violate human rights despite the constitutionl and the Moroccan political system continues to violate human rights despite the constitutional and legal arsenal stipulated to protect the rights and freedoms of citizens . Finally , to achieve the process of democratic transition un Morocco , it is necessary to achieve a new political consensus , veritcal and horizontal and clear with the features a modern, Moroccan civil state based on a constitution consensue document that breaks with the existing, constitutional political thought and establishes a state based on the principle of equitable distribution of powers and the principle of separation of powers and where the principle of protecting the freedom and rights of citizens is the main objective. في بداية التسعينات ،دخل المغرب مرحلة حديثة من تاريخه السياسي هدفها تحقيق رهان الانتقال الديمقراطي باعتباره الحل الافضل لخروج المغرب من الازمة الداخلية والخارجية التى عانى منها في السبعينات والثمانينات ، والتى يعود السبب الرئيسي فيها الى تأزم الظروف الداخلية الاقتصادية و الاجتماعية والسياسية ، بالإضافة الى تعرض المغرب لضغوط اقليمية تمثلت في تداعيات نجاح الثورة الايرانية وتصاعد مد الحركات الاسلامية في العديد من الدول العربية و الاسلامية وكذا تأثر المغرب بتجارب الانتقال الديمقراطي في كل من (تونس ، الجزائر ، موريتانيا) فيما يعرف بنظرية العدوى او كرات الثلج المتدحرجة ،الى جانب تأثر المغرب بضغوط دولية سببها انهيار الاتحاد السوفياتى وبروز الاحادية القطبية بقيادة الولايات المتحدة الامريكية ، وتطبيق المؤسسات المالية سياسة المشروطية السياسية مقابل منح القروض للمغرب . اهتم النظام السياسي المغربي بثلاث مؤشرات لتحقيق عملية الانتقال الديمقراطي ، تمثلت في عقد توافق سياسي بين المؤسسة الملكية والمعارضة ترجم الى تناوب سياسي جسد في تكوين أول حكومة تناوب توافقي عام 1996 ، وكذا تعديل الاطار الدستوري بصورة تدريجية على ثلاث مرات ، حيث كان التعديل الاول والثاني في عهد الملك الحسن الثانى عام 1992 و 1996 ، اما التعديل الثالث و الاخير فكان عام 2011 في عهد الملك محمد السادس ،بالإضافة الى الاهتمام بمدخل حقوق الانسان من خلال وضع ترسانة قانونية للحفاظ على حقوق وحريات المواطنين واستخدام استراتيجية محددة لمعالجة ملف انتهاكات حقوق الانسان. ان تطبيق مؤشرات الانتقال الديمقراطي في المغرب حققت خطوات ايجابية في مسار الديمقراطية لكنها لم تكن كافية لتحقيق عملية انتقال ديمقراطي فعلية ،فالمغرب مزال يعيش مرحلة المرور من مرحلة الاستبداد الى مرحلة الديمقراطية ، وتعود أسباب ذلك لسيطرت المؤسسة الملكية على صياغة الاصلاح السياسي والدستوري بصورة تكتيكية فوقية افقية تحافظ من خلالها على مكانتها المهيمنة على العملية السياسية وعلى المؤسسات الدستورية ، وعلى صلاحياتها الواسعة سواء الدستورية المستمدة من الدستور المكتوب والمتعلقة بحقل رئاسة الدولة أو الصلاحيات الغير الدستورية المستمدة من الدستور العرفي والمتعلقة بحقل امارة المؤمنين و الحكم . هذا الازدواج في مؤسسات النظام السياسي المغربي (مؤسسات تقليدية ، مؤسسات حديثة) يعيق من عملية الانتقال الديمقراطي لان المؤسسات التقليدية تهمين على المؤسسات الحديثة وتفرغها من مضمونها ، في حين ان تحقيق عملية الانتقال الديمقراطي تتطلب القطيعة مع الماضي وانهيار المؤسسات القديمة واستبدالها بمؤسسات ديمقراطية حديثة . بالإضافة الى ما سبق ، تعانى عملية الانتقال الديمقراطي في المغرب من ضعف مؤسسات المجتمع المدنى وعدم قدرتها على القيام بأدوارها بسبب جملة من المعيقات الداخلية والخارجية التى تكبل استقلاليتها وتجعلها تابعة للدولة ، بالإضافة الى استمرار النظام السياسي المغربي في انتهاك حقوق الانسان رغم الترسانة الدستورية والقانونية المنصوص عليها لحماية حقوق وحريات المواطنين . أخيرا ، لتحقيق عملية الانتقال الديمقراطي بالمغرب لابد من تحقيق توافق سياسي جديد علنى عمودى وافقى واضح يرسم معالم جديدة لدولة مدنية مغربية حديثة تقوم على اساس وثيقة دستورية توافقية تحدث القطيعة مع الفكر السياسي والدستوري القائم وتؤسس لدولة تقوم على مبدأ التوزيع العادل للسلطات ومبدأ الفصل بين السلطات وتكرس مبدأ حماية حقوق وحريات المواطنين .
