حقوق الإنسان و سياسة الولايات المتحدة الأمريكية بعد أحداث 11 سبتمبر 2001

Abstract

This study aims to identify the fact that the impact of the policy of the United States made known after the events of September 11, 2001 on human rights. These events in the United States in their own backyard, which hit the centers of power and vigor to it, and away from the controversy over the existing acts, although this has a major role in the analysis of that policy, but we believe that the stand to identify these effects depends on knowledge of other hubs, however, is mainly to know the impact of these events on U.S. policy in both its internal and external, and then determine the implications of this policy on human rights inside and outside America, and then access the results of these reflections. In fact, the general character of the internal and external American policy wings has been taken as a priority of combating terrorism in all ways and means. In order to eliminate this new phenomenon, through a strategy, which the United States has led all the countries of the world, headed by the representative of international community: the United Nations. As if the world were leading a global war against an illusive enemy without any specific place or time. And all is about a group of regions aligned with some of the people, which the United States calls Islamic terrorism. To be sure, this war of America has had serious repercussions on human rights. This war was led by the dangerous overtaking of international legitimacy, who has violated its principles as well as those rights of States and individuals through detention centers at Abu Ghraib and Guantánamo to the best evidence. Therefore, these effects oblige us to talk about the possibility of the international and US responsibility about the grave violations of the rights of nations and individuals by making their leaders compelled and prosecuted as as if they were criminals. The international community and the USA may have committed a variety of serious international crimes, which was prohibited by the international law. The study provides the legal basis for the convening of this responsibility, and legal avenues to pursue and prosecute all those found involved in these crimes witnessed by the human voice and image. تھدف ھذه الدراسة الوقوف على حقیقة تأثیر سیاسة الولایات المتحدة الأمریكیة المنتھجة بعد أحداث 11 سبتمبر 2001 على حقوق الإنسان. ھذه الأحداث التي تعرضت لھا الولایات المتحدة في عقر دارھا والتي ضربت مراكز القوة والعنفوان لدیھا، وبعیدا عن الجدل حول القائم بالأفعال ، بالرغم أن لذلك دورا كبیرا في تحلیل تلك السیاسة، إلا أننا نرى أن الوقوف على تحدید ھذه الآثار مرھون بمعرفة محاور أخرى، تتلخص أساسا في معرفة تأثیر ھذه الأحداث على السیاسة الأمریكیة بشقیھا الداخلي والخارجي ، ثم بعدئذ تحدید انعكاسات ھذه السیاسة على حقوق الإنسان داخل وخارج أمریكا، ثم الوصول إلى نتائج ھذه الانعكاسات. وفي الحقیقة، فإن الطابع العام للسیاسة الأمریكیة بجناحیھا الداخلي والخارجي قد اتخذ كأولویة شعار مكافحة الإرھاب بكل الطرق والوسائل، من اجل القضاء على ھذه الظاھرة الجدیدة القدیمة، من خلال إستراتیجیة أمریكیة سخرت لھا الولایات المتحدة كل دول العالم ، تتقدمھم ممثلة الشرعیة الدولیة :الأمم المتحدة . وكأني بالعالم یقود حربا عالمیة ضد عدو زئبقي غیر محدد المكان ولا الزمان، غیر ما ھنالك مجموعة من الأقالیم المشایعة بعض أھلھا لما تسمیھ الولایات المتحدة بالإرھاب الإسلامي. والأكید أن لھذه الحرب الأمریكیة انعكاسات خطیرة على حقوق الإنسان ، یتقدمھم التجاوز الخطیر للشرعیة الدولیة، من خلال انتھاك مبادئھا المعروفة، وكذا انتھاك حقوق الدول وحقوق الأفراد ، وما معتقلات غوانتنامو و أبو غریب لخیر دلیل. ولذلك فإن ھذه الآثار تجرنا إلى الحدیث حول إمكانیة انعقاد المسؤولیة الدولیة للولایات المتحدة ، حول انتھاكاتھا الخطیرة لحقوق الشعوب والأفراد، مما یجعل قادتھا عرضة للمساءلة والمحاكمة باعتبارھم مجرمین ، قد ارتكبوا أصنافا شتى من الجرائم الدولیة الخطیرة التي حرم القانون الدولي القیام بھا ،متوعدا فاعلھا ومن ساعده وشایعھ بالعقاب. وتقدم ھذه الدراسة الأسس القانونیة لانعقاد ھذه المسؤولیة ، والطرق القانونیة لملاحقة ومحاكمة كل من ثبت تورطھ في ھذه الجرائم التي عاشتھا البشریة بالصوت والصورة.
