القرائن الطبية المعاصرة و آثارها الفقهية

Abstract

هذه الأطروحة مقدمة لنيل درجة دكتوراه علوم في الشريعة تخصص فقه و أصوله، و الموسومة ب: "ّالقرائن الطبية المعاصرة وآثارها الفقهية"، من إعداد الطالب: صديق مروج، تحت إشراف الأستاذ الدكتور: صالح بوبشيش.ّ و موضوع القرائن الطبية المعاصرة من أهم القرائن في الطب الشرعي والتحقيق القضائي، لا يستغنى عنها سواء في وجود الأدلة المباشرة أو في غيابها أو عند تعارضها، وهي التي يلجأ إليها القاضي فيكثير من الأحوال لفك ألغاز القضية أو الجريمة. و جاءت هذه الأطروحة للإجابة على الإشكاليات التالية: هل للقاضي سلطة اجتهادية في اتخاذ كل ما استجد من القرائن الطبية في الإثبات القضائي و الحكم بمقتضاه أم أن سلطته محدودة؟ ما هي مجالات العمل بالقرائن الطبية المعاصرة؟ و ما هي الضوابط الشرعية و الفنية للعمل بها ؟ّّ و للإجابة على هذه الإشكاليات، قسمت البحث إلى مقدمة و ثلاثة أبواب و خاتمة، فكان الباب الأول في حقيقة القرائن الطبية المعاصرة و أنواعها و علاقتها بأدلة الإثبات المباشرة و شروط العمل بها، و الباب الثاني كان في دور و أثر القرائن الطبية المعاصرة في مجال الأحوال الشخصية و الحقوق المالية، و الباب الثالث و الأخير كان في دور و أثر القرائن الطبية المعاصرة في مجال الحدود و القصاص. و في نهاية البحث، توصلت إلى مجموعة من النتائج، من أهمها: 1- للقرائن الطبية المعاصرة دور أساسي و محوري في الطب الشرعي و الإثبات القضائي، سواء عند وجود الأدلة المباشرة أم لا، أو عند تعارضها. 2- يعتمد على القرائن الطبية المعاصرة في الإثبات القضائي في باب الأحوال الشخصية و الحقوق المالية. 3- لا يعتمد عند الجمهور على القرائن الطبية المعاصرة في الإثبات القضائي في باب الحدود و القصاص، و يعمل بها في التعزير إذا قويت التهمة.ّ This thesis is submitted to obtain the degree of Doctor of Science in Sharia, specializing in jurisprudence and its origins, and tagged with: "Contemporary medical evidence and its jurisprudential effects", prepared by the student Seddik Meroudj, under the supervision of Prof. Dr. Salah Boubechiche. The topic of contemporary medical evidence is one of the most important clues in forensic medicine and judicial investigation. It is indispensable, whether in the presence of direct evidence, in its absence, or when it contradicts, and it is what the judge resorts to in many cases to decipher the mysteries of the case or crime. This thesis came to answer the following problems: Does the judge have discretionary authority to take all the new medical evidence in judicial proof and judgment accordingly, or is his authority limited? What are the areas of work with contemporary medical evidence? What are the legal and technical controls for working with contemporary medical evidence? In order to answer these problems, the research was divided into an introduction, three chapters, and a conclusion. The first chapter dealt with the reality of contemporary medical evidence and its types and its relationship to direct evidence and the conditions for working with it. The second chapter was on the role and impact of contemporary medical evidence in the field of personal status and financial rights, and the third and final chapter was In the role and impact of contemporary medical evidence in the field of punishment and retribution. At the end of the research, it reached a set of results, the most important of which are: 1- Contemporary medical evidence has a fundamental and pivotal role in forensic medicine and judicial proof, whether direct evidence exists or not, or when there is conflict. 2- It relies on contemporary medical evidence for judicial evidence in the personal status and financial rights section. 3- It is not relied upon by the public on contemporary medical evidence for judicial proof in the chapter on punishment and retribution, and it is applied in reprimanding if the accusation is strong.
