دور الجماعات الإقليمية في حماية البيئة

Abstract

Regional groups are considered to be as an extension of the central administration in all areas , and the environmental fieldis considered one of the most important areas in which regional groups have local competences as environmental probens are considered one of the greatest threats to all humanity and since the issue of the envirenment is no longer an internal or local issue that one of the countries suffers from and is trying to find solutions to it , it has become a global issue as it concerns all countries of the world , problems and damage related to environment do not know geographical borders of contries such as Algeria , witch paid attention to the issue of environmental protection in general and considered it as a priority and was abreast with the modern approach by integrating the environmental dimension into every developental activity that may harm the environment in which we live , and thus alaw was issed nis-a-vis environmental protection within the framework of sustainable development 03-10 . The study tagged with ʺThe Role Of Regional Groups In Protecting The Environment ʺ , examinesthe powers that regional groups posses in order to protect the environment within the algerian legislation through successive laws of the municipality and the wilaya , as well as various lows related tp the envirenment , added to this the legal mechanisms and procedures taken by regional groups to preserve the environment , whether procedures taken by regional groups to preserve the environment , whether preventive – before the accurrence of environment damage – in prder to provide the necessary protection for the environment by the wilaya and the municapality at the level of their regions . From this perspective , a preliminary vision was formed about the powers that regional groups possess in order to protect the environment in the algerian ligislation , this vision which was detailed through this thesis to lnow the real role that both the municipality and the wilaya play in this field. تعتبر الجماعات الإقليمية إمتدادا للإدارة المركزية في جميع المجالات، و يعتبر المجال البيئي من أهم المجالات التي تمتلك بشأنه الجماعات الإقليمية إختصاصات محلية، إذ تعتبر المشاكل البيئية من اكبر الأخطار تهديدا للبشرية جمعاء، حيث لم تعد قضية البيئة قضية داخلية أو محلية تعاني منها بعض الدول و تحاول إيجاد حلول لها، بل أصبحت قضية ذات طابع عالمي، كون الأضرار البيئية صارت لا تعرف الحدود الجغرافية للدول، مما جعل الجزائر كغيرها من دول العالم تواكب هذا النهج الحديث و تهتم بموضوع الحماية البيئية و تجعله من أولوياتها، فأدمجت البعد البيئي ضمن كل عمل تنموي قد ينجر عنه أي ضرر في الوسط الذي يحيط به، و بذلك صدر قانون حماية البيئة في إطار التنمية المستدامة 03-10 . و قد تناولت هذه الدراسة الموسومة ب: "دور الجماعات الإقليمية في حماية البيئة" الصلاحيات التي تمتلكها الجماعات الإقليمية من اجل حماية البيئة في ظل التشريع الجزائري من خلال قوانين الولاية و البلدية المتعاقبة إلى جانب القوانين المختلفة ذات الصلة بالبيئة، و كذلك الآليات و الإجراءات القانونية المتخذة من قبل الجماعات الإقليمية للحفاظ على البيئة، سواء كانت وقائية قبل حدوث الضرر البيئي أو علاجية لإصلاح الضرر البيئي، قصد توفير الحماية اللازمة للبيئة من قبل الولاية البلدية على مستوى أقاليمها. من هذا المنطلق تم تشكيل رؤية مبدئية حول الصلاحيات التي تمتلكها الجماعات الإقليمية من أجل حماية البيئة في التشريع الجزائري، و التي تم محاولة تفصيلها و التعمق فيها من خلال هذه الأطروحة لمعرفة الدور الحقيقي الذي تقوم به كلا من البلدية و الولاية في هذا المجال.
