الإجتهاد المقاصدي و تطبيقاته عند فقهاء المغرب العربي المعاصر

Abstract

تناولت الدراسة موضوع الاجتهاد المقاصدي عند فقهاء المغرب العربي المعاصر، مع بعض النماذج التطبيقية. و جاء فيها بعد بيان المقصود من الاجتهاد المقاصدي، رجالات هذا الفن في بلاد المغرب العربي الحديث، و اختارت الباحثة ثلاثة نماذج، تمثل الريادة في هذا العصر، و هم الشيخ المحفوظ عبد الله بن بيه، و الدكتور عبد المجيد عمر النجار، و الدكتور احمد الريسوني. ثم جاء الشق النظري، الذي بنت فيه الباحثة معالم الاجتهاد المقاصدي، ببيان مجالاته و مسالكه و اثاره في فهم النص الشرعي و رفع التعارض و الترجيح. لتختتم الدراسة بجملة من القضايا التطبيقية التي مثلت بجلاء البعد و النظر المقاصدي عند الاعلام المعاصرين. و عليه فموضوع الاجتهاد المقاصدي من الموضوعات الحية، التي تحتاجها الامة لضمان سيرورة الاحكام الشرعية، و بناء الفقه المقاصدي. This study is about (Al ijtihad El makasidi) by some of modern Maghrebian scholars with some applicable models. This statement deals with the definition of (Al ijtihad El makasidi), and its leaders in the modern Maghreb, therefore, the researcher chooses three models that represent the leadership of (Al ijtihad El makasidi) in the current era that are: Al Seikh Abdallah Ibn Baya, Dr. Abdulmajid Najjar and Dr Ahmed RaÎssouni. And then comes the theoretical side, in which the researcher builds the basics of (Al ijtihad El makasidi), it's different areas and pathways, and its effects on the understanding of religious texts and clearing contradictions and weighting. Finally, the researcher ends up the study with a series of practical issues which clearly draw the dimension and views of (Al ijtihad El makasidi) for contemporary scholars. To sum up things, (Al ijtihad El makasidi) is an essential subject to guarantee the right processing of Sharia rulings and building the right jurisprudence of (Al ijtihad El makasidi).
