منهج الفتوى و تطبيقاته عند محمد الطاهر إبن عاشور

Abstract

تناول هذا البحث منهج الفتوى و تطبيقاته عند الشيخ محمد الطاهر ابن عاشور، فهذا الموضوع جاء ليدرس الفتوى و أحكامها الشرعية من مفاهيم و شروط و آداب و ضوابط جامعة لصناعة الفتوى، و يبحث في الوقت ذاته عن منهج المفتي ابن عاشور عبر فتاويه و تطبيقاتها، و أهم الأصول و المصادر التشريعية المعتمدة لديه. فالبحث إذن يتعلق بموضوع الاجتهاد الفقهي في أبرز صورته "الفتوى"، و يجيب عن إشكالية محورية هي: ما هي أهم معالم الأسس المعتمدة لدى مفتي تونس في صناعته للفتوى؟ و هل له ما يميزه عن غيره من المفتين؟ ما حقيقة الفتوى عنده؟ و ما المنهج الذي اعتمده في فتاواه و كيف طبقه؟ و حاولت هذه الدراسة الإجابة عن تلك التساؤلات في أربعة فصول: الفصل الأول: عنونته بحياة موجزة عن السيرة الذاتية للرجل و عرض موسع لمفهوم الفتوى؛ بحثت فيه تعريف الفتوى و مفهومها و منزلتها و مشروعيتها و وقفت على باقي مباحث مرتبطة بالموضوع حول شروط ضابطة لصانع الفتوى و آداب عامة، ثم ختمته بمزالق المفتي و تحديد ضوابط الفتوى لدى ابن عاشور. أما الفصل الثاني: فكان عنوانه " أسس منهج الفتوى عند ابن عاشور." تعرضت فيه لبيان مفهوم المنهج باختصار، ثم ذكرت أهم أسس ذلك المنهج، حيث تبين أن للشيخ منهجا معتمدا ثابت المعالم بنى عليه معظم فتاواه، و هو منهج يعتمد فيه الالتزام بالمذهبية و نبذه للتعصب و مراعاته لفقه التيسير و منهج الوسطية و الاعتدال و فهم الواقع. أما الفصل الثالث من هذا المبحث فكان بعنوان "أصول الفتيا عند محمد الطاهر ابن عاشور" ولقد شملت الد ا رسة معظم الأدلة النقلية والعقلية التي اعتمدها ابن عاشور. أما الفصل الأخير فقد تناولت صناعة الفتوى عند ابن عاشور الشكلية و المضونية عرضا لبعض الاستفتاءات و المراسلات التي تمت بينه و بين مراسليه، و وقفت على أهم خصائص الفتوى و مصادرها التي اعتمدها ابن عاشور في صناعته للفتوى وختمت البحث بخاتمة أثبت فيها نتائج البحث المتوصل إليها، و مرفقا بها بعض التوصيات. This study is an approach to Sheikh Muhammad Al-Taher Ibn Ashur’s method and applications in fatwa. While trying to study the fatwa and its chariaa’s jurisdictions in terms of concepts, conditions, etiquette, and comprehensive regulations that are necessary in fatwa’s creation, this study is also analyzing the methods of Mufti Ibn Ashour through his fatwas and their applications, and the most important principles and sources of chariaa that are used by the fatwa maker. - Ibn Ashour - The research, then, is concerned by the topic of Diligence in Fikh , in its most prominent form, "the fatwa", and answers an important problematic: Does the great Sheikh Al-Mafsir, Al-Maqasadi have a hand and delegacy in the fatwa? What is the real face of his fatwa? What is the approach adopted in his fatwas and how did he apply it? This study attempted to answer these questions in four chapters: The first chapter: entitled it with a brief life of the man’s career and an expanded presentation of the concept of fatwa. we discussed in it, the definition of fatwa, its concepts, its status and its legitimacy, and examined the rest of the topics that are related to fatwa regarding the conditions that are followed by fatwa maker and it’s general morals, then concluded the chapter with a research on the pitfalls of the mufti and determining the ways of the fatwa of Ibn Ashour. As for the second chapter: It was entitled "Foundations of the Approach to Fatwa by Ibn Ashour." In which we exposed a brief explanation for the concept of the curriculum, then we mentioned the most important foundations of that approach, as it was found that the Sheikh has a strict way with fixed features on which he built most of his fatwas. And it’s a method that is built on doctrinal disputes, his renunciation of intolerance and taking into account the jurisprudence of facilitation (fikh el-taysir) and the methodology of moderation and understanding of reality. As for the third chapter was titled “The Fundamentals of the Fatwa according to Muhammad al-Taher Ibn Ashur.” His sources of legal and intellectual legislation became clear in this chapter, and the study included most of the transitional and mental evidence adopted by Ibn Ashour. As for the last chapter, it dealt with the formality and content of Ibn Ashour's fatwa making a presentation of some referendums and the correspondence that took place between him and his correspondents, the most important applications and their images, and stood on the most important characteristics of the fatwa and its sources that Ibn Ashour adopted in making the fatwa The research concluded with a conclusion in which it confirmed the findings of the research and attached some recommendations.
