التنظيم القانوني لدور الأحزاب السياسية في الرقابة على العملية الإنتخابية في الجزائر

Abstract

الأحزاب السياسية باعتبارها من أهم الفاعلين في الحياة السياسية في الدولة تؤدي دورا هاما في دعم الممارسة الديمقراطية من خلال الوظائف المختلفة التي تؤديها، وتساهم عن طريق نشاطها على مختلف المستويات في غرس الثقافة والوعي السياسي بما يتوافق مع منهجها في إطار احترام القانون، فهي من الركائز الأساسية للديمقراطية، لأنها تشكل أداة لتأطير المشاركة السياسية التي تعد معيارا لسلامة العلاقة بين السلطة وأفراد الشعب. المشرع الجزائري في النصوص القانونية المتعلقة بالانتخابات نص على ضمانات قانونية لتنظيم عملية انتخابية تحترم فيها إرادة الناخبين وتوفر فيها الحماية لأصواتهم من أي تزوير قد يحرفها عن مبتغاها، وهو في ذلك حرص على إشراك جميع الفاعلين في العملية الانتخابية لضمان نزاهتها، ونظرا للدور الهام للأحزاب السياسية في تجسيد التداول السلمي على السلطة، واعتبارا أنها الطرف الأساسي في المشاركة السياسية والمنافسة في الانتخابات المختلفة، ونتيجة لمصلحتها العامة والخاصة في شفافية العملية الانتخابية، فالمشرع أولاها دورا هاما في الرقابة على مختلف مراحلها. Les partis politiques ont une très grande importance dans la vie politique d’un état, donne un rôle important à la democratie.par ses différentes activités, ces partis participent à tous les niveaux afin d’importer la culture et la conscience politique et ceci dans le cadre du respect de la loi, ainsi ces partis sont considérés parmi les piliers les plus importants de la démocratie parce qu’ils constituent l’outil de la participation politique qui est considéré comme baromètre de la bonne relation entre le pouvoir et le peuple. Le projet algérien de loi des élections donne des garanties quand à l’organisation d’une élection où la voix des électeurs est protégée ainsi que leurs choix, saine de toute fraude. C’est ainsi que ce projet a donné la chance à tous participants aux élections pour une meilleure garantie de sa honnête. Ainsi, il a donné aux partis politiques un rôle très important quand à la surveillance de toutes les étapes des élections, et ceci parce que ces partis sont considérés comme une pièce très importante dans la vie politique d’un pays et la concurrence dan les différentes élections. the political prties hve a great importance in the political life of any state or country and that in order to give a great role to the democracy. By their different activités, those parties participate in all levels and that is to implant the culture and the political conscience without neglecting the respect of the law. Also, those parties are considered as the most important pillars of the democracy as they are considered. The tool of political participation which is the barometre of the good relationship between the people and overnement. Te Algerian project concerning the elections law give guaranties to the organization of any election in which the choice and the voice of the elections is protected from a y fraud. Therefore, this project has given the chance to all participants for the elections a better garranty for honesty. More over, it has given to the political parties a great role to surprise ll the steps of the elections because these parties are considered as an important piece nd pillar in the political life of any country and the concurence in the different elections.
