أثر مراعاة المقاصد في أحكام الأسرة و تطبيقاته المعاصرة

Abstract

جاءت هذه الدراسة لتبحث في اثر اعمال المقاصد في مجال هام و حيوي يتعلق بركيزة هامة في المجتمع صمام الامان فيه و هو الاسرة، في محاولة لضبط وسائل تحقيق ذلك و تسليط الضوء على تطبيقات ذلك في الاجتهاد المعاصر. و اثناء بحث مفردات هذه الدراسة تبين ان مسالة اعمال المقاصد بشكل عام في الاجتهاد و المقاصد الاسرية بشكل خاص ليست وليدة هذا العصر، بل هي عمل متاصل منذ عصور الاجتهاد الاولى، و ان اختلف مجاله ضيقا و اتساعا على حسب الظروف و الازمان، و هذا ان دل على شيء فانما يدل على المكانة الكبيرة التي تشغلها الاسرة في الاسلام و الاهتمام البالغ الذي اولاه الشارع الحكيم لها من خلال العديد من التشريعات المفصلة في القران الكريم و السنة النبوية الشريفة. و قد خلصت الدراسة من خلال جانبيها النظري و التطبيقي الى ان العمل بالمقاصد في الاجتهاد في قضايا الاسرة من اهم و ادق الوظائف التي تناط بفقهاء و علماء اليوم خاصة في ظل الاستهداف المباشر و الصارخ للاسرة المسلمة اليوم. و قد لبى علماؤنا الافاضل هذا الواجب فاجتهدوا و سعوا في ذلك الى التقليل من نسبة الخطا عند تصوير المسائل و من ثم الحكم عليها بالاعتماد على المتخصصين في كل مجال تعنيه النازلة محل البحث، و كذا اعتماد الاجتهاد الجماعي ممثلا في المجامع الفقهية كالية لتحقيق ذلك دون منع الاجتهادات الفردية، شرط الالتزام بالضوابط العامة و الخاصة للمجتهد حتى لا يخوض غمارها من ليس اهلا لها. اسال الله تعالى ان اكون قد وفقت في عرض ذلك بالشكل العلمي الصحيح و المفيد، فان اصبت فمن الله وحده و ان اخطات فمن نفسي و من الشيطان و اخر دعوانا ان الحمد لله رب العالمين. Cette étude a pour examiner l'impact de la réalisation des objectifs dans un domaine important et vital pour des importantes soupape de sécurité communautaire dans laquelle une famille, pour tenter de régler les moyens pour y parvenir et mettre en évidence les applications dans la jurisprudence contemporaine. Pendant le vocabulaire de recherche de cette étude montrent que la question de la réalisation des objectifs en général dans la diligence et à des fins de famille en particulier, ne sont pas le résultat de cette époque, il est une oeuvre enracinée depuis l'âge de la première diligence, mais une portée différente étroite et élargir en fonction des circonstances et des temps sur, cela signifie quoi que ce soit, il montre la grande position que la famille occupe dans l'Islam et la grande attention que lui porte la rue sage à travers de nombreuses législations détaillées dans le Saint Coran et la Sunna. L'étude a conclu par les parties théoriques et pratiques pour travailler dans des fins de diligence raisonnable dans les problèmes familiaux des emplois les plus importants et les plus précis confié scientifique aujourd'hui, en particulier à la lumière de ciblage direct et manifeste aujourd'hui la famille musulmane. Nos scientifiques ont rencontré le ce devoir distingué, tendre et recherché pour réduire le taux déerreur lors de la prise des questions, puis jugé en faisant appel à des spécialistes dans tous les domaines moyenne calamité en question, ainsi que l'adoption des représentants de diligence collective dans les conseils en tant que mécanisme pour y parvenir sans empêcher des interprétations individuelles, la condition Respecter les règles générables et spéciales des diligents, pour ne pas être contesté par ceux qui n'en sont pas dignes. Je demande à Dieux Tout-Puissant que je suis en mesure de le considérer comme le droit scientifique et utile, j'étais le seul Dieu, mais il a manqué moi-même et du diable, et Louange à Allah, le Seigneur des mondes. This study is intended to examine the impact of the implementation of the objectives in an important and vital field related to an important pillar in society, the safety valve which is the family, in an attempt to control the means of achieving this and highlight the applications of this in contemporary Ijtihad. The study of the vocabulary of this study shows that the question of the implementation of the purposes in general in Ijtihad and the family goals in particular is not the result of this age, but is an inherent work since the early periods of Ijtihad, although its scope varies narrowly and wide depending on circumstances and times. The great position that the family occupies in Islam and the great attention paid by the wise street to it through many of the detailed legislations in the Holy Quran and Sunnah. The study concluded through the theoretical and practical aspects that the work of the purposes of ijtihad in family issues is one of the most important and precise functions that are entrusted to scholars and scholars today, especially in light of the direct and blatant targeting of the Muslim family today. Our distinguished scholars responded to this duty, so they tried to reduce the error rate when photographing the issues and then judging them by relying on the specialists in each field and the adoption of the collective ijtihad represented in the jurisprudential councils as a mechanism to achieve this without preventing individual judgment. To abide by the general and special rules of the diligent, so as not to be contested by those who are not worthy of it.
