الطرق المستحدثة في إنشاء وتسيير المرافق العامة

Abstract

باتساع دور الدولة تعددت المرافق العامة التي تتولى إنشاءها لتلبية حاجات مواطنيها، ثم في مرحلة لاحقة أصبح دورها يقوم على استراتيجية أساسها العمل على بعث الحيوية في كل مرافقها وهنا اتجهت لإصلاحها وزيادة كفاءتها، الأمر الذي لم تتمكن من تحقيقه لوحدها لذا شجعت القطاع الخاص على مشاركتها في ذلك لتتمكن من الاستمرار في عالم المنافسة وحرية السوق. وأمام اتساع حاجات جمهور المرتفقين التي تستتبع بالضرورة التوسع في إنشاء المرافق العامة، والتي تتطلب موارد مالية ضخمة عادة ما لا تتوافر لديها بالنظر لعجز موازناتها، كان لزاما على الدول التوجه للبحث عن أسلوب تعاقدي جديد يحقق لها ذلك مع ضمان جودة الخدمات المقدمة دون الزيادة الكمية فقط، وكانت عقود البوت هي السبيل لذلك وأصبحت طريقا مستحدثا في إنشاء وتشغيل المرفق العام تتولى فيه شركة المشروع المتعاقد معها إنشاءه وتشغيله في مرحلة ثانية لمدة تختلف من عقد لآخر بنهايتها تنقل ملكية المرفق العام للدولة المضيفة خاليا من أي أعباء مالية. With the expanded role of the state, the number of the public facilities, that has to set up in order to meet its citizens’ needs, has increased. Then, at a later stage, its role has became relying on a strategy based on the revitalization of its facilities by repairing them and increasing their efficiency, what the state was not be able to realize alone, that is why it has encouraged the implication of the public sector to ensure its stay in the competition world and free market. With regard to the broad needs of the public which necessarily followed with the expansion of the establishment of public facilities, which in its turn requires huge financial resources that are not usually available due to the budget deficits, countries have had to look for new contractual method to deal with that issue and ensuring the quality of the provided services without only an increased quantity. The BOT contracts has became a new way in building and operating the public facility where the contracted project company takes the responsibility of its building and then, in a second phase, bringing it to service for a period that differs from one contract to another, and by the end of this period, the ownership of that public facility would be transferred to the host country all free of any financial charges.
