فتح القريب المجيب بشرح كتاب الترتيب للشنشوري (ت 999 ه)

Abstract

يتناول هذا البحث دراسة حياة عالم من علماء الأزهر البارزين في القرن العاشر، وهو الإمام عبد الله الشنشوري، الذي هو إمام الفرائض في زمانه، وأيضا تحقيق كتابه ((فتح القريب المجيب بشرح كتاب الترتيب)) في الفرائض، الذي هو عمدة كتبه، إذ من المقرر وجوب الرجوع إلى التراث الإسلامي، لمعرفة الجهود الذي بذلها الأوائل، وما قدموه لخدمة هذا الدين الحنيف، والتراث الإسلامي هو ركيزة الدين والواصلة التي تربط بين السلف الخلف. وقد تمثلت عناصر هذا البحث في مقدمة، وقسم الدراسة، وقسم التحقيق، وخاتمة. المقدمة. وفيها التعريف بالموضوع، وإشكالية البحث، وأهمية الموضوع، وأهدافه، وأسباب اختياره، والدراسات السابقة فيه، والمنهج المتبع فيه، والمنهجية المتبعة في كتابته، ثم صعوباته. القسم الأول : الدراسة . وفيه فصلان: الفصل الأول: التعريف بالإمام الشنشوري. وفيه ثلاثة مباحث: المبحث الأول: عصر الإمام الشنشوري. ويتناول الحياة السياسية، والاجتماعية والاقتصادية، والعلمية والفكرية في عصر الإمام الشنشوري. المبحث الثاني: حياة الإمام الشنشوري الشخصية. ويتناول اسم ونسب الإمام الشنشوري، ومولده ونشأة ووفاته. المبحث الثالث: حياة الإمام الشنشوري العلمية. ويتناول شيوخ الإمام الشنشوري ورحلاته العلمية، وتصدره للتدريس وأبرز تلاميذه، ومذهبه الفقهي، ومكانته وآثاره العلمية. الفصل الثاني: التعريف بكتاب فتح القريب المجيب. وفيه ثلاثة مباحث: المبحث الأول: التعريف بكتاب المجموع للإمام الكلائي. ويتناول التعريف بالإمام الكلائي، والتعريف بكتابه المجموع. المبحث الثاني: التعريف بكتاب ترتيب المجموع للإمام سبط المارديني. ويتناول التعريف بالإمام سبط المارديني، والتعريف بكتابه ترتيب المجموع. المبحث الثالث: دراسة كتاب فتح القريب المجيب. ويتناول تحقيق عنوان كتاب فتح القريب المجيب ونسبته للمؤلف، وسبب وتاريخ تأليف كتاب فتح القريب المجيب، ومضمون كتاب فتح القريب المجيب ومنهج المؤلف فيه، واهتمام العلماء بكتاب فتح القريب المجيب، ثم وصف النسخ المعتمدة في التحقيق. -القسم الثاني : التحقيق. أما قسم التحقيق فيتضمن خمسة أبواب من كتاب ((فتح القريب المجيب بشرح كتاب الترتيب))، وهي: 1- باب: تصحيح المسائل. وفيه ثلاثة فصول، وهي: فصل فإن وقع الانكسار على فريقين، ثم فصل وإن وقع الانكسار على ثلاثة فرق، ثم فصل وإذا كان الانكسار على أربعة فرق. 2- باب: ذكر مسائل الرياضة في الفرائض. وفيه اثنا عشر فصلا، وهي: فصل الاثنين، ثم فصل الثلاثة، ثم فصل الأربعة، ثم فصل الستة، ثم فصل الثمانية، ثم فصل الاثني عشر، ثم فصل الأربعة والعشرين، ثم فصل في استخراج نصيب كل وارث، ثم فصل في عمل المناسخة، ثم فصل اعلم أن المناسخة بالجدول إلخ، ثم فصل وإذا مات قبل القسمة ثالث، ثم فصل في قسمة التركات. 3- باب: الوصايا. وفيه اثنا عشر فصلا صغيرا غير معنونة، ثم خمسة فصول كبيرة، وهي: فصل في مسائل العول والوصايا، ثم فصل فيما إذا أوصى لبعض ورثته، ثم فصل في الوصية بمثل النصيب أو بالنصيب، ثم فصل فيما إذا أوصى بمثل نصيب بعض ورثته إلخ، ثم فصل فيما إذا أوصى بمثل نصيب أحد ورثته. 4- باب: في المسائل الدوريات من الوصايا والأقارير. وفيه خمسة فصول، وهي: فصل فيما إذا أوصى لشخص إلخ، ثم فصل فيما إذا أوصى لشخص بمثل النصيب إلخ، ثم فصل فيما إذا أوصى لكل من شخصين إلخ، ثم فصل ويشبه هذه المسائل، ثم فصل واعلم أن الألفاظ المصطلح عليها. 5- باب: في الميراث بالتقدير والاحتياط. وفيه تسعة فصول وخمسة فوائد، وهي: فصل في مسائل منثورة، ثم فوائد وهي: الفائدة الأولى في متشابه النسب والألغاز، ثم الفائدة الثانية في الرد، ثم الفائدة الثالثة في توريث ذوي الأرحام، ثم فصل فأما توريث ذوي الأرحام، ثم فصل ومن الأصناف بنات الإخوة إلخ، ثم فصل ومن الأصناف الأجداد الساقطون إلخ، ثم فصل ومن الأصناف الأخوال إلخ، ثم فصل الطرف الثاني في ترتيب الأصناف، ثم فصل قد يجتع في الشخص من ذوي الأرحام قرابتان بالرحم، ثم فصل إذا كان مع ذوي الأرحام زوج أو زوجة، ثم الفائدة الرابعة في الإقرار بالنسب، ثم فصل آخر وإن أقر مقر إلخ، ثم الفائدة الخامسة في الولاء ثم خاتمة الكتاب. الخاتمة. وقد تضمنت النتائج المتوصل إليها والتوصيات.
