Abstract

The study which is entitled “The Consideration Effect to the Purposes of the Assigned in the Ruling on the Blasphemous Terms” combines two compounds: the blasphemous expressions and the purposes of the assigned. It sheds light on the ruling of the blasphemous expressions from a religious, intentional, authentic, and jurisprudential perspective. Significantly, it reveals the balance between the scholars' authenticity to the apparent basic ruling in Islamic and blasphemous issues and their approvals, taking into account the assigned purposes in the blasphemous words. The research was divided into an introduction, three parts, and a conclusion. The introduction which consists of a preliminary discussion deals with the context of the study. It offers a brief background about the area of the research and sheds light on the research’s main problem. It discussed the major aims and objectives of conducting this research, hypotheses, significance, the research questions that this study attempts to answer, and systematically the organization of the research. Furthermore, limitation of the research, previous Studies, methodological orientation of the research, the choice of method adopted; and the factors influencing the design of the study are investigated. Part one offers definitions to the title’s vocabulary: the intention of the assigned; blasphemous terms in both basic source and inferred meaning of the term. It is divided in two chapters. Chapter one provides an insightful notion on the assignee’s intention as one of the research poles and pillars through its definition and evidence of its consideration, its importance, the relationship of the assignee's intention to the legislator's purposes, and the sections of the assignee's purposes. Chapter two is devoted to defining both faith and disbelief between the narrators (Ahl El Hadeeth) and (El Moutakalimeen) and the evidence for them, and a clarification of the term blasphemy, evidences for it, its divisions being the second pillar of the subject. Part two discusses disbelief issues and the ruling of blasphemous terms. It is divided in two chapters. Chapter one offers warnings of the danger of haste in disbelief, then discussing the regulations of disbelief by explaining the causes of disbelief, its conditions and prohibitions. Chapter two presents three levels of consideration and ruling on disbelief words. Hence, the first level is related to the doctrinal aspect aiming to clarify the truth to the relationship between the inner and the apparent in faith and disbelief whereas the second level is related to the juristic fundamentalist aspect aiming to clarify what the fundamentalists and jurists have decided; in that the juristic ruling structure in faith and disbelief issues is on the outward appearance in case of availability of conditions and absence of inhibitions. The third level which is concerned with the intentional aspect indicates the assigned purposes considered in terms of disbelief. Part three which is divided to three chapters is devoted to the practical side of the research. It includes the doctrines of the jurists in expelling the basic apparent ruling with the extent of their consideration to the assigned intention in the terms of explicit and non-explicit disbelief, stating the scope of the ruling and its difference according to the different intentions and expressions. Chapter one elaborates the correct intent and the extent of its consideration on the overt and explicit blasphemous expressions. The researcher has significantly mentioned the most famous ones in real life such as blasphemy insult, mockery; and fun and humour with blasphemous terms. Chapter two is a clarification to the corrupt intent and its effect on overt blasphemous expressions. The researcher represented three affecting symptoms on the intent validity namely: coercion; drunkenness and faults (pre-tongue). Chapter three determines the consideration effect to the assigned intention on the non-explicit blasphemous terms. The researcher has chosen among them: the call for the unity of religions; congratulation of non-Muslims to their festivals. However, due to the seriousness of the disbelief with blasphemous terms, the researcher conducted a chapter discussing the scholars’ doctrines in the disbelief by using blasphemous terms holding on to those who disbelieve in non-explicit words without regard to the purposes of those assigned with it. The conclusion which closes the research provides a general conclusion, summary of the findings, suggestions and recommendations to future researchers. موضوع بحث " أثر اعتبار مقاصد المكلف في الحكم على الألفاظ المكفرة" يجمع بين مركبين: الألفاظ المكفرة ومقاصد المكلفين، فهو يسلط الضوء عن حكم ألفاظ الكفر وذلك من منظور عقائدي، مقاصدي، تأصيلي، فقهي، ليكشف التوفيق بين تأصيلات العلماء لقاعدة الحكم على الظاهر في مسائل الإسلام والكفر، وبين تقريراتهم بمراعات مقاصد المكلفين في ألفاظ الكفر. ومن أجل ذلك قسمت البحث إلى مقدمة وثلاثة أبواب وخاتمة. ذكرت في مقدمة إشكالية البحث، وأهميته والهدف منه، وأسباب اختياره، والمنهج المتبع فيه، والدراسات السابقة، ومنهجية الكتابة في البحث، وخطته، والصعوبات التي واجهت الباحث. الباب الأول: تناولت فيه شرح مفردات العنوان: قصد المكلف؛ ولفظ الكفر تأصيلا واستدلالا، وذلك في فصلين: الأول منهما: تحدثت فيه عن قصد المكلف باعتباره أحد أقطاب البحث وأركانه من خلال تعريفه والأدلة على اعتباره، وأهميته، وعلاقة قصد المكلف بمقاصد الشارع، وأقسام مقاصد المكلف، أما الفصل الثاني: ذكرت تعريف كل من الإيمان والكفر، بين أهل الحديث والمتكلمين والأدلة عليهما، ومن ثم انتقلت لبيان تعريف لفظ الكفر، والأدلة عليه، وأقسامه، باعتباره الركن الثاني من أركان الموضوع. الباب الثاني: ذكرت فيه مسائل حول التكفير والحكم على ألفاظ الكفر في فصلين: حذرت في الأول منهما من خطورة التسرع في التكفير، ثم تحدثت عن ضوابط التكفير من خلال بيان سبب الكفر وشروطه وموانعه، وجعلت الفصل الثاني للحديث عن مستويات النظر والحكم على ألفاظ الكفر، حيث تعلق الأول منها بالجانب العقدي والغرض منه بيان حقيقة العلاقة بين الظاهر والباطن في الإيمان والكفر، والثاني متعلق بالجانب الأصولي الفقهي والقصد منه إيضاح ما قرره الأصوليون والفقهاء، من أن مبنى الأحكام الشرعية في مسائل الإيمان والكفر على الظاهر بعد توفر الشروط وانتفاء الموانع، والثالث منها يتعلق بالجانب المقاصدي والمراد منه بيان أن مقاصد المكلفين معتبرة في ألفاظ الكفر. الباب الثالث: كان بمثابة الجانب التطبيقي لهذا البحث، حيث ذكرت فيه مذاهب الفقهاء في طرد قاعدة الحكم بالظاهر مع مدى اعتبارهم لقصد المكلف في ألفاظ الكفر الصريح وغير الصريح، وبيان مناط الحكم واختلافه باختلاف المقاصد والألفاظ، وجعلته في ثلاثة فصول، الأول: للقصد الصحيح ومدى اعتباره على ألفاظ الكفر الصريح، حيث ذكرت أشهرها في الواقع: السب الكفري؛ والاستهزاء والهزل بألفاظ الكفر، أما الفصل الثاني: للقصد الفاسد وأثره على ألفاظ الكفر الصريح، حيث مثلت فيه لثلاثة عوارض مؤثرة على صحة القصد وهي: الإكراه؛ والسكر؛ والخطأ (سبق اللسان)، والفصل الثالث: مدى اعتبار قصد المكلف على ألفاظ الكفر غير الصريح، واخترت منها: الدعوة إلى وحدة الأديان؛ وتهنئة غير المسلمين بأعيادهم، ولخطورة التكفير بلازم القول عقدت مبحثا ذكرت فيه مذاهب العلماء في التكفير بلازم القول، كونه مستمسك من يكفر بالألفاظ غير الصريحة دون اعتبار لمقاصد المكلفين منها. وختمت البحث بخاتمة ذكرت فيها أهم النتائج التي توصلت إليها والتوصيات المقترحة.
