Abstract

All praise is due to Allaah, the Lord of all that exists, and may peace and blessings be upon our Prophet Muhammad, To proceed : in this research, The researcher highlighted the aspects of the Renewing Fiqh to a great jurisprudential personality in the modern era, namely Sheikh "Mustafa Ahmed Zarqa", the importance of talking is manifested about the renewal of jurisprudence for one of savants of contemporary jurisprudence which needs renovation in order to be applicable And to satisfied the needs of the era and to upgrade the leadership of the Islamic nation, the researcher has been interested in highlighting the aspects of the renewing of for this savant, which is considered by some scholars a renewer of the islamic jurisprudence in modern contemporary, it is hard to find speech of researcher about Renewing Fiqh without mentioning the Sheikh "Zarqa" so much , the aspects of his renovation offers prospects for those who comes after him wanting to renew , especially after the period of stagnation that islamic jurisprudence went through that required renewal in order to Follow the evolution of the era. The aim of the researcher by this work is to highlight the theme of innovation in Islamic jurisprudence and what is accepted and what is rejected, and the maturity of the researches in its issues Such as legalization of Fiqh and theories of fiqh through what he has written and its unique experience with innovation. in addition to this the researcher was aiming through this research to highlight the aspects’s personnality of this great scientist to be fair with him as other contemporary savants and give him the right of study and appreciation The researcher divided his research into an introductory chapter; containing the biography of the savant "Zarqa " and concepts about the Renewing Fiqh, in the first chapter handled what the Sheikh cared about extremely and dedicated his life for it which is the renewal in the formulation of jurisprudence represented in the theories and encyclopedias jurisprudence, In the second chapter, he referred to Zarqa's opinion about the legalization of Fiqh, where he made a large part of his writings about legalization of Fiqh and considered it the way to make Islamic jurisprudence applicable, in the third chapter, the researcher speaks about the renewal of" Zarqaa "in the fatwa in terms of form and in terms of judgment and discretion and the researcher gave some of his Innovative fatwas in the Contemporary jurisprudential issues, while the speech in the fourth chapter was about important issues occupied a great part of jurisprudential thinking of the savant Zarqaa which is : Legal Maxims of Islamic Jurisprudence and the jurisprudence of banks and the Islamic economy and academys of fiqh. The researcher reached a number of results, the most important of it is that Sheikh Mustafa "Zarqa" is one of innovators in the modern era, and that the most important thing he speak about in the renewing of fiqh is renewing of jurisprudence wording represented in the theories and Legal Maxims of Islamic Jurisprudence, legalization of Fiqh, he interested about legalization of Fiqh so much and he puts its foundations and he gave his opinion about its issues, He was one of the innovators of the fatwa in form and content, and he had singularities and discretions in contemporary jurisprudence cases in which he known in both economic and medical issues. He had contributions in the encyclopedias of fiqh, and he was one of its founders and among those who were contributed in establishing it. And Praise be to Allah, the Lord of the World. الحمد لله الذي بنعمته تتم الصالحات والصلاة والسلام على من أتم الله به الرسالات وبعد: فقد سلط الباحث الضوء في هذا البحث على معالم التجديد الفقهي عند شخصية فقهية كبيرة في العصر الحديث ألا وهو الشيخ "مصطفى أحمد الزرقاء"، وتبرز أهمية الكلام عن التجديد الفقهي عند علم من أعلام الفقه المعاصر في أن هذا الفقه يحتاج إلى تجديد كي يكون صالحا للتطبيق وموفيا بحاجات العصر وناهضا بريادة الأمة الإسلامية، وقد اهتم الباحث بإبراز معالم التجديد عند هذه الفقيه الذي عده بعض الباحثين مجدد الفقه في العصر الحديث، فلا يكاد يخلو كلام باحث في التجديد الفقهي إلا ويكون للشيخ الزرقاء فيه الحظ الأوفر من الذِّكرً، وكذلك فإن إبراز معالم التجديد عنده يعطي آفاقا تفيد مريد التجديد بعده، خاصة بعدما مر الفقه الإسلامي بٕحالة من الجمود استدعت التجديد فيه كي يواكب العصر. وقد كان الباحث يهدف من خلال هذا البحث إلى جانب إبراز معالم شخصية هذا العالم الفذ وإنصافه كغيره من فقهاء العصر وإعطائه حقه من الدراسة والإشادة، كان يهدف الباحث كذلك إلى تسليط الضوء على موضوع التجديد في الفقه الإسلامي وما يقبل منه وما يردُّ، وإنضاجً الكلام في مسائله والتقنين والتنظير من خلال ما كتبه هذا العالم وتجربته المميزة مع التجديد. وقد قسم الباحث بٕحثه إلى فصل تمهيدي؛ حول التعريف بالشيخ الزرقاء ومفاهيم عن التجديد الفقهي، وفصلا أول تناول فيه ما اهتم به الشيخ اهتماما كبيرا وكرس حياته لأجله ألا وهو التجديد في صياغة المادة الفقهية ممثلة في النظريات والموسوعات الفقهية، وتطرق في الفصل الثاني إلى نظرة الزرقاء إلى تقنين الفقه الإسلامي حيث جعل له حيزا كبيرا من كتاباته للكلام عن التقنين واعتبره هو السبيل لجعل الفقه الإسلامي قابلا للتطبيق، وتناول الباحث في الفصل الثالث تجديد الزرقاء في الفتوى من حيث الشكل ومن حيث إصدار الحكم والاجتهاد وأعطى الباحث بعضا من فتاويه التجديدية في القضايا المعاصرة، بينما كان الكلام في الفصل الرابع عن قضايا مهمة شغلت حيزا من الفكر الفقهي للشيخ الزرقاء وهي التقعيد الفقهي وفقه المصارف والاقتصاد الإسلامي والمجامع الفقهية. وقد توصل الباحث إلى جملة من النتائج أهمها أن الشيخ مصطفى الزرقاء من المجددين في العصر الحديث، وأن أهم ما تطرق إليه في تجديد الفقه تجديد الصياغة الفقهية متمثلة في النظريات الفقهية والقواعد الفقهية، والتقنين الفقهي الذي اهتم به كثيرا وأسس له ونظر لمسائله، وكذلك كان من المجددين في الفتوى شكلا ومضمونا، وكانت له تفردات واجتهادات في قضايا فقهية معاصرة عرف بها سواء في القضايا الاقتصادية والطبية وغيرها، وكانت له مشاركات في الموسوعات الفقهية بل كان من المؤسسين لها ومن الذين لهم الفضل في إنشائها. وآخر دعوانا أن الحمد لله رب العالمين.
